These Terms of Service (“Terms”) govern your use of FirstCareNow(the “Platform”), operated by Xphora AI Technology Pvt. Ltd. on the Dactorly telemedicine platform. By using the Platform or booking a consultation, you agree to these Terms. If you do not agree, please do not use the Platform.
1. What FirstCareNow is — and is not
FirstCareNow is a technology platform that helps you discover verified, independent registered medical practitioners (“Doctors” / “RMPs”) and connect with them for online consultations over WhatsApp. FirstCareNow is not a hospital, clinic, or healthcare provider, does not practise medicine, and does not provide medical advice. No doctor–patient relationship is formed with the Platform; it is formed solely between you and the Doctor you consult.
2. Not for emergencies
The Platform is not designed for medical emergencies. If you are experiencing a medical emergency, call 112 or go to the nearest hospital immediately. Do not use FirstCareNow for urgent or life-threatening conditions.
3. Eligibility
You must be 18 years or older to use the Platform on your own behalf. Consultations for a minor or a dependent must be booked and supervised by a parent or legal guardian, who accepts these Terms on their behalf.
4. How consultations work
- You choose a Doctor or specialty and start a chat over WhatsApp.
- You pay the consultation fee shown for that Doctor before the consultation is confirmed.
- The consultation, clinical advice, and any prescription are provided entirely by the Doctor in accordance with the Telemedicine Practice Guidelines, 2020 and applicable professional codes.
- You are responsible for providing accurate, complete, and honest information; the quality of the consultation depends on it.
5. Fees, payments, and refunds
Consultation fees are displayed on each Doctor’s card and are collected through our payment partner, Razorpay. Fees are inclusive of applicable taxes unless stated otherwise. Refunds, where applicable (for example, if a Doctor is unable to attend a paid consultation), are handled on a case-by-case basis and are processed manually; contact support@firstcarenow.com to request one.
6. Prescriptions
Any prescription is issued at the sole professional discretion of your Doctor and only where clinically appropriate under the Telemedicine Practice Guidelines, 2020. FirstCareNow merely delivers the prescription your Doctor chooses to send. The Platform does not guarantee that any consultation will result in a prescription.
7. No automated clinical advice
The Platform does not provide automated or AI-generated clinical advice. Any AI-assisted feature is advisory, clearly labelled, and exists only to support the Doctor — never to replace their judgement. All clinical decisions are made by your registered medical practitioner.
8. Your responsibilities
- Provide accurate identity, contact, and health information.
- Use the Platform only for lawful, personal, non-commercial purposes.
- Do not impersonate others or misuse another person’s details.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the Platform.
9. Disclaimers
The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties regarding the availability, accuracy, or reliability of the service and of any information provided by Doctors. FirstCareNow is not liable for the clinical judgement, advice, or outcome of any consultation, which is the sole responsibility of the treating Doctor.
10. Limitation of liability
To the maximum extent permitted by law, Xphora AI Technology Pvt. Ltd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Where liability cannot be excluded, it is limited to the consultation fee you paid for the specific consultation giving rise to the claim.
11. Intellectual property
The FirstCareNow name, logo, design, and content are owned by Xphora AI Technology Pvt. Ltd. or its licensors. The Platform is “Powered by Dactorly”. You may not copy, reproduce, or use them without written permission.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the competent courts in India.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
